The U.S. Supreme Court has ruled in B&B Hardware v. Hargis Industries Inc. that issue preclusion applies to the registration decisions of the Trademark Trial and Appeal Board if the ordinary elements of issue preclusion are met. The Court noted that “Congress’ creation of an elaborate registration scheme, with many important rights attached and backed up by plenary review, confirms that registration decisions can be weighty enough to ground issue preclusion.”

How Trademark Law Got Started in the US
The first commercial marks are believed to have been used by pre-historic cattle herders to indicate ownership of livestock and by Egyptian brick-makers to identify their building materials. Later, manufacturers of medieval armor marked their goods to indicate the origin and quality of their materials.
